Refund Policy
Please review the terms and conditions governing returns, replacements and refund requests for goods purchased from CropMineral, LLC.
This Refund Policy explains the circumstances under which CropMineral, LLC (“CropMineral”, “Seller”, “we”, “us” or “our”) may accept returns, replacements or refunds for goods (“Goods”) sold to any purchaser (“Buyer”). Because many Goods offered by CropMineral are chemical, industrial or agricultural products that require controlled handling, storage and transportation, all sales are generally considered final unless otherwise agreed in writing by CropMineral or required by applicable law.
This Refund Policy should be read together with our Conditions of Sale and any contract, quotation, invoice or other written agreement governing the transaction. In the event of any conflict between this Refund Policy and the express terms of a specific written agreement with the Buyer, that written agreement shall prevail.
1. General Policy
Due to the nature of the Goods we sell, CropMineral does not accept routine returns and does not provide refunds as a matter of convenience. Refunds, credits, replacements or return approvals may be granted only in limited circumstances, including where the Goods are proven to have been delivered in a damaged condition, materially defective, short in quantity, or different from the Goods confirmed in writing by CropMineral.
- All requests are subject to review and approval by CropMineral in its sole reasonable discretion.
- No return, replacement or refund is valid unless expressly authorised in writing by CropMineral.
- The Buyer must comply with all safety, handling, storage, packaging, labelling and transportation requirements applicable to the Goods at all times.
2. Order Cancellations
Orders may only be cancelled with CropMineral’s prior written consent. Once an order has been processed, prepared for shipment, loaded, dispatched, or delivered to a carrier, cancellation may be refused or may be subject to cancellation charges, restocking charges, freight costs, administrative costs and any third-party costs incurred by CropMineral.
- Custom, special-order, allocated, bulk, export, hazardous or regulated Goods may not be cancellable once confirmed.
- Any approved cancellation does not automatically entitle the Buyer to a refund in full.
3. Eligibility for Return or Refund
CropMineral may consider a return, replacement or refund request only if all of the following conditions are satisfied:
- the Buyer submits a written claim within seven (7) days following delivery of the Goods;
- the claim includes sufficient details, including invoice or order reference, product identification, batch or lot information where applicable, quantity affected and a description of the issue;
- the Buyer provides supporting evidence reasonably requested by CropMineral, including photographs, shipping documents, inspection notes or other relevant records;
- the Goods have not been used, blended, processed, repackaged, relabelled, contaminated or altered in any way;
- the Goods have been stored, handled and transported in accordance with all applicable requirements and industry standards after delivery; and
- CropMineral determines, after review, that the request is valid under this Refund Policy and any applicable contract terms.
4. Non-Returnable Goods
Without limiting CropMineral’s general right to reject return requests, the following Goods are ordinarily non-returnable and non-refundable, except where required by applicable law or expressly approved in writing by CropMineral:
- opened, used, partially used or tampered Goods;
- Goods that have been repackaged, relabelled, diluted, mixed, combined or incorporated into any process or finished product;
- Goods stored improperly or in conditions inconsistent with product requirements;
- custom, special-order, non-stock, made-to-order or specially sourced Goods;
- hazardous materials, dangerous goods, regulated substances or Goods requiring special disposal or controlled transport;
- Goods sold on a clearance, closeout, final-sale or non-cancellable basis;
- Goods for which the claimed issue results from the Buyer’s handling, storage, transport, misuse, negligence or use outside normal or intended parameters; and
- Goods returned without prior written authorisation from CropMineral.
5. Damaged, Defective, Short or Incorrect Deliveries
The Buyer must inspect the Goods promptly upon delivery. If the Buyer believes that any Goods were delivered damaged, defective, short in quantity, or not in conformity with the order confirmation, the Buyer must notify CropMineral in writing within seven (7) days following delivery.
- The Buyer must preserve the Goods, packaging, pallets, labels and shipping documentation for inspection.
- The Buyer must not use, transfer, resell or dispose of the affected Goods unless required for safety reasons or authorised by CropMineral in writing.
- CropMineral may request additional information, arrange inspection, or require samples before making a decision.
6. Return Authorisation Procedure
No Goods may be returned without prior written return authorisation from CropMineral. If CropMineral approves a return, CropMineral may provide instructions regarding packaging, labelling, carrier selection, documentation, routing, delivery location and timing.
- The Buyer must follow all return instructions exactly.
- Unauthorised returns may be refused, destroyed, held at the Buyer’s risk and expense, or returned to the Buyer at the Buyer’s cost.
- The Buyer remains responsible for the Goods until they are received and accepted by CropMineral at the designated return location.
7. Shipping, Handling and Compliance for Returns
Where a return is approved, the Buyer must ensure that the Goods are packed, labelled, documented and shipped in full compliance with all applicable laws, regulations and carrier requirements, including any rules relating to hazardous materials, environmental protection, workplace safety and import/export control.
- CropMineral may refuse any return shipment that does not comply with applicable safety or legal requirements.
- If a return requires special transport, disposal, inspection or handling, the related costs may be charged to the Buyer unless the return results solely from CropMineral’s confirmed error.
8. Inspection and Resolution
All approved returns are subject to inspection by CropMineral. Receipt of returned Goods does not mean that a refund or credit has been approved. After inspection, CropMineral may determine, in its reasonable discretion, whether to:
- reject the claim;
- replace the affected Goods;
- issue a partial or full credit;
- issue a refund; or
- apply another commercially reasonable remedy.
Any refund, credit or replacement will be limited to the extent permitted by the applicable contract and law, and nothing in this Refund Policy expands any warranty or remedy beyond those expressly provided by CropMineral.
9. Refund Method and Timing
If CropMineral approves a refund, the refund may be issued to the original payment method where reasonably practicable, or otherwise by bank transfer, credit memo or account credit, as determined by CropMineral. Processing times may vary depending on the payment channel, banking procedures, internal review and completion of any required inspection.
- Original shipping charges, insurance, duties, taxes, customs fees and similar charges are non-refundable unless the return is due solely to CropMineral’s confirmed error.
- Any approved refund may be reduced by applicable restocking, handling, freight, disposal, banking or third-party charges where permitted by law and the governing contract.
10. Restocking and Other Charges
Approved non-defective returns, if accepted at all, may be subject to a restocking fee and any additional costs incurred by CropMineral, including but not limited to inspection costs, repackaging costs, disposal costs, freight charges, storage fees, banking charges and administrative expenses.
The amount of any such deduction will depend on the nature of the Goods, the condition in which they are returned, the return route and any third-party costs incurred.
11. No Refunds in Certain Cases
Refunds, credits or replacements will not be provided where the claim arises from:
- improper storage, handling or use of the Goods after delivery;
- normal variations within applicable specifications or tolerances;
- the Buyer’s failure to inspect the Goods promptly upon delivery;
- regulatory, permitting, import, licensing or end-use restrictions applicable to the Buyer or the Buyer’s jurisdiction;
- market price changes, customer cancellation, downstream resale issues or lack of demand; or
- any event outside CropMineral’s reasonable control.
12. Limitation of Remedies
To the fullest extent permitted by applicable law, any refund, credit, replacement or other remedy granted under this Refund Policy shall be the Buyer’s sole and exclusive remedy with respect to the relevant Goods. CropMineral shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, loss of business, loss of opportunity or third-party claims arising from or related to any return, refund or rejected claim.
13. Relationship to Other Terms
This Refund Policy is supplemental to, and should be read together with, CropMineral’s Conditions of Sale, Terms & Conditions, Privacy Policy and any applicable contract documents. Nothing in this Refund Policy shall be interpreted as limiting any rights that cannot lawfully be excluded under applicable law.
